The Licensing Sub-Committee
returned the following decision:
The conversion of the existing Justices Off-Licence to a Premises
Licence under Schedule 8 to the Licensing Act 2003 was granted.
The variation application under Section 34 of the Licensing Act 2003
to extend trading hours was refused in its entirety.
Therefore permitted hours remain as converted from the Licensing
Act 1964, namely:
- On weekdays, other than Christmas Day, 8am to 11pm.
- On Sundays, other than Christmas Day, 10am to 10-30pm.
- On Christmas Day, 12 noon to 3pm and 7pm to 10-30pm.
- On Good Friday, 8am to 10-30pm.
The refusal of the variation application was made on the grounds that the application was contrary to the licensing objectives, as follows:
- On the prevention of crime and disorder, the police evidence and objections indicate that extended hours would exacerbate anti-social behaviour, crime and disorder.
- On the prevention of public nuisance, the police evidence and objections indicate that the extended hours would add to, rather than prevent, public nuisance.
- On the protection
of children from harm, although there was no specific evidence presented,
the Sub-Committee took into account police concerns regarding the
sale of alcohol to underage people - which would be contrary to this
objective.
