Before setting up a mobile food business you should consider where you wish to trade, for example on a market, in an open space, trading on a street or layby, or at an organised event.

To trade on private land you need the permission of the landowner and should speak to the planning department to see if any planning permission is required.

If you wish to trade on a street, there are a number of streets in the borough which you are prohibited from trading on. You should contact the Highway Agency if you wish to trade on a major road or layby.

The Environmental Health Department does not give permission to trade on specific pitches/areas or issue street trading licences.

You need to register your food business at least 28 days before opening.

  • If you run a ;non-permanent market stall you need to register with the Local Authority in which the food stock is ordinarily kept
  • A mobile food establishment must register with the Local Authority in which it is ordinarily kept overnight or returns to between trading (eg: this could be at the private house or a separate lock up)
  • If you have more than one mobile establishment please seek advice from the Food Safety Team as to whether each should be registered separately or as one single establishment.

Your business will be inspected to ensure compliance with food safety legislation by the Local Authority you are registered with. You may also be inspected whist you are trading. If you trade in a different area, copies of any inspection reports will be sent to the Local Authority you are registered with.

The majority of food business will receive a National Food Hygiene Rating, this will generally be given by the Local Authority you are registered with. They will also consider any information supplied by other Local Authorities who have inspected the establishment when determining the rating.
